Urgent Plumbing Repairs for Renters in Victoria

Urgent plumbing repairs in a rental property are the rental provider’s job, and Victorian law says they have to be done immediately. If your toilet is blocked, a pipe has burst or the hot water has stopped working, this guide explains which problems count as urgent, what to do first, when you can call a plumber yourself and how to get your money back.

It is written for renters, and it is also useful for rental providers and property managers who need to know what is expected of them.

Which Plumbing Problems Count as Urgent Repairs

Consumer Affairs Victoria publishes the full list of urgent repairs. These are the ones that involve plumbing or gas:

  • A burst water service.
  • A blocked or broken toilet system.
  • A gas leak.
  • Flooding or serious flood damage.
  • An essential service or appliance for hot water, water, cooking, heating or laundering that is not working.
  • The gas or water supply not working.

The list also covers problems such as a serious roof leak, a dangerous electrical fault and anything that makes the property unsafe or insecure. You can read the complete list on the Consumer Affairs Victoria repairs page.

Non-Urgent Plumbing Repairs

Problems that are annoying but don’t stop you using the home are non-urgent. A dripping tap, a slow sink or a loose tap handle usually fall into this group. Ask for the repair in writing, and the rental provider has 14 days from getting your written request to fix it.

A small problem can turn urgent. A dripping tap is non-urgent, but a pipe spraying water is a burst water service, so report changes as they happen.

Who Pays for Urgent Plumbing Repairs

The rental provider pays for urgent repairs. That includes a burst pipe in the wall, a failed hot water system and a toilet that won’t flush because the pipe is broken.

The exception is damage the renter causes. If a toilet blocks because something was flushed that shouldn’t have been, the renter can be asked to cover the cost. A plumber’s report usually shows the cause, which is another reason to keep the invoice and any photos.

What to Do When Something Goes Wrong

  1. Make it safe. For a burst pipe, turn off the water at the meter. For a gas leak, turn off the gas at the meter if you can do it safely, leave the property and call the gas emergency line. Our guide on what to do when a pipe bursts walks through the steps.
  2. Contact your rental provider or agent straight away, by phone and then in writing so there is a record.
  3. If they can’t be reached or don’t fix it immediately, you can arrange the repair yourself, up to a set limit. Consumer Affairs Victoria lists the current amount. Use a licensed plumber or gasfitter.
  4. Keep the plumber’s invoice, a short report of what was wrong, photos and copies of your messages to the rental provider.
  5. Send the rental provider written notice of what you paid. Consumer Affairs Victoria says the rental provider must pay you back within 7 days of getting that notice.
  6. If you are not repaid, or the repair isn’t done, you can apply to Rental Dispute Resolution Victoria (RDRV), a free service. If RDRV can’t resolve it, the matter can go to VCAT.

If the Repair Costs More Than the Limit

There is a limit on how much a renter can spend on an urgent repair and claim back, and the current amount is listed on the Consumer Affairs Victoria repairs page. Some plumbing jobs cost more, such as replacing a hot water system or a section of sewer pipe. In that case, keep asking the rental provider in writing to arrange the repair, and contact RDRV if it isn’t done.

A plumber can usually make the property safe and working for now, for example by isolating a burst pipe, and then quote for the full repair. That quote is useful evidence if the rental provider is slow to act.

A Note for Rental Providers and Property Managers

Urgent repairs have to happen immediately, so it helps to have a plumber on file before something goes wrong. Give your renters a clear emergency contact and make sure they know where the water meter and gas meter are. Most urgent plumbing calls are a burst pipe, a blocked toilet or a hot water failure, and all three are easier to manage with a 24/7 plumbing service ready to call.

For apartments, find out which pipes are common property. Leaks between apartments often involve the owners corporation, and our guide to leaking balconies and strata responsibility explains how that boundary works.

This guide is general information, not legal advice. Check the Consumer Affairs Victoria website for the rules that apply to your situation.
